When a person's car is rear-ended, that person typically assumes that the other driver is at fault. However, thay may not always be the case.
In certain circumstances, the driver whose car is rear-ended may be partially or fully repsonsible for damages. For instance, if that driver stops so suddenly that it would be unreasonable to expect the trailing driver to stop in time, then the liability may be alloted to both drivers. The possible allotment is often determined by a state's comparitive negligence laws.
