Which driver is responsible when a car is rear-ended?

Posted on October 19th, 2009 No Comments

When a person's car is rear-ended, that person typically assumes that the other driver is at fault. However, thay may not always be the case.

In certain circumstances, the driver whose car is rear-ended may be partially or fully repsonsible for damages. For instance, if that driver stops so suddenly that it would be unreasonable to expect the trailing driver to stop in time, then the liability may be alloted to both drivers. The possible allotment is often determined by a state's comparitive negligence laws.

If you have rear-ended another car and believe the other driver is partially responsible, contact the Des Moines auto accident attorneys of LaMarca & Landry at 877-327-2600.
